What is the Difference Between a Guardianship and an Adoption?

Adopting a child is a wonderful and a complex task in this country today, which can often no longer take place without the help of an adoption lawyer. That is because there are few children available for adoption and the child custody laws are so strict and complicated that they cannot be navigated without the help of an adoption lawyer. In most cases, parents cannot fulfill all the child custody laws to adopt a child without the guidance of an adoption lawyer. However, the rewards are great when an adoption lawyer can help a child and a couple be matched to create a family.

Guardianship, on the other hand, is not always as difficult as adoption, though it does take time and requires a great deal of legal paperwork for which you can call upon a guardianship lawyer. In addition, guardianship is not always limited to children. If an adult is incapacitated due to illness, drug or alcohol addiction, or a mental or physical disability he may require the help of a guardianship lawyer to appoint a guardian.

In many cases, guardianship is not as difficult or expensive as adoption, often because the biological parents of the person are still alive and may still provide some degree of support and guidance. Child custody laws often mandate the appointment of a guardian when the parents are temporarily incapable or unfit to care for the child, when there is substantial money given to the child that must be protected until he becomes an adult, or when there is a specific situation in which the child needs independent representation to care for his interests in times of legal, medical, or emotional conflict with his family. In those cases, a guardianship lawyer is required to represent the potential guardians and guide them through the child custody laws.

How Child Custody Laws Concerning Adoption and Guardianship Differ
Adoption is a permanent situation in which a child is awarded to his adoptive parents with the help of an adoption lawyer. Child custody laws require that the adoptive parents be thoroughly investigated and be found suitable parents for a minor child. An adoption lawyer can help adoptive parents present their home situation, finances, and character effectively to the investigating agency. When an adoption occurs and an adoption lawyer helps finalize this legal action, the relationship between the child and his biological parents is permanently terminated and generally cannot be resorted. When the biological parents die, the child who has been legally adopted has no right to inherit his parents’ estate.

Guardianship, on the other hand, is generally not permanent, though in some cases in can be. Even when a guardianship lawyer helps finalize the process, the legal relationship between a child and his biological parents is not permanently terminated. If the parents are temporarily unable to care for their child and child custody laws require that he be removed for his safety, a guardianship lawyer can help reverse that decision if the parents become capable caretakers again. In addition, if the circumstances in which the child needed a guardian change, your guardianship lawyer may terminate the legal relationship under child custody laws and return the child to his biological parents. Again, child custody laws require that a guardian be a suitable caretaker for the child, whether the guardianship is long or short term. In order to fulfill child custody laws, guardians should also consult a guardianship lawyer.

When Guardianship Is Required
Child custody laws mandate several reasons why a person may require a guardian, which can be appointed with the help of a guardianship lawyer.
  • When child custody laws have determined that the parents are incapable or unwilling to provide the support and guidance a child needs a guardianship lawyer can help provide a legal guardian.
  • When the child has received a significant amount of money or property and child custody laws require that someone to protect and use the money or property for the child alone, a guardianship lawyer will help secure an appropriate guardian.
  • When a child is involved in a custody battle and child custody laws determine that he needs a temporary guardian, or a guardian ad litem, to present his interests to the court, a guardianship lawyer can serve as his guardian or that guardianship lawyer can arrange for someone else to do so.
  • When a child has physical issues in which child custody laws, parental decisions, and medical advice differ and someone must be appointed to represent the interests of the child, a guardianship lawyer can facilitate the appointment of a temporary guardian or the guardianship lawyer can become the temporary guardian to represent the child.
Selecting a Guardian
In many cases, parents will choose a guardian for their minor children and, with the help of a guardianship lawyer, designate that guardian in their will. The guardianship lawyer can then guide the child and his guardians through the child custody laws to inherit the estate of his parents, but be cared for by the guardian until adulthood. In other instances, child custody laws allow the child’s own parent to be chosen as his guardian, often with the help of a guardianship lawyer. He and his guardianship lawyer are then responsible to prepare regular reports to satisfy child custody laws concerning the use of money and property.

In some situations, a child may be living with a relative or a friend while his parents are incapable of caring for him or after they have passed away. A guardianship lawyer can help determine if those caretakers need to undertake legal guardianship. In most cases, if they will be caretakers for longer than a few months, child custody laws require that those caretakers work with a guardianship lawyer to legalize the relationship.

The Adoption Process
Adoptive parents have, with the help of adoption lawyers, increasingly turned to overseas adoptions because of the scarcity of children to adopt in this country. In most such instances, it is vital that the couple consult an guardianship lawyer for many elements of the process. A guardianship lawyer can help you find a reputable overseas adoption agency. You can file the appropriate legal papers in this country with the help of your adoption lawyer. That same guardianship lawyer can also guide you through the investigation process. When the child arrives, your adoption lawyer can help you complete the immigration papers for the child. You will need an family lawyer to make sure you fulfill all child custody laws during the process as well.
